We handle personal information in accordance with the New Zealand Privacy Act 2020 and its Information Privacy Principles.

Licence and software activation information

To issue, activate, validate, manage and protect Tribute Director licences, we may collect technical and licence-related information such as:

  • Your customer or account identifier

Website and technical information

When you use our website or online services, our systems may automatically collect technical information such as:

  • IP address
  • Browser and device type
  • Operating system
  • Date and time of access
  • Pages or services requested
  • Login, session and security information
  • Server logs and error information

We use this information to operate the website, maintain security, diagnose problems, prevent abuse and improve our services.

Communications and support

If you contact us, we may retain information contained in your communication, including your name, email address, support request, correspondence and any information or files you voluntarily provide to help us diagnose or resolve a problem.

2. Funeral, Memorial and Media Content

Tribute Director is designed to manage and play media such as music, photographs, videos, slideshows, lyrics and other service content on the user's computer.

Tribute Director does not ordinarily upload or store your funeral, memorial or service media on our licensing servers simply because you use the application.

Media loaded into Tribute Director remains under the user's control on their computer or connected storage unless the user deliberately provides content to us, for example as part of a technical support request.

Where Tribute Director provides browser-based remote control functionality on an authorised iPhone, iPad or other device, that functionality is designed to operate over the user's local network. Its purpose is to control the Tribute Director application and does not, by itself, create a cloud copy of the user's funeral or media library on Tribute Director's licensing servers.

If you provide funeral, memorial or other client information to us for technical support, you are responsible for ensuring that you are authorised to provide that information. We will use information supplied for support only for purposes reasonably connected with providing that support, maintaining our services, meeting legal obligations or protecting our legitimate interests.

3. How We Collect Personal Information

We generally collect personal information directly from you when you:

  • Download licensed software
  • Contact us for support
  • Submit a website form
  • Communicate with us by email or other means

We may also receive personal information indirectly from organisations that provide services to us, including payment providers such as Stripe, where this is necessary to complete a transaction, confirm payment, manage a licence, prevent fraud, provide support or administer our services.

Where the Privacy Act 2020 requires us to notify you about personal information collected indirectly, we will take reasonable steps to provide the required information unless an applicable exception applies.

4. Why We Collect and Use Your Information

We may use personal information to:

  • Create and administer your Tribute Director account

5. Information Required to Provide the Service

Some personal information is necessary for us to provide Tribute Director.

For example, we need sufficient information to identify an account holder, process a purchase, associate a licence with the correct customer, verify software entitlement and manage authorised installations.

If you choose not to provide information that is reasonably required for these purposes, we may be unable to create your account, process a purchase, issue or activate a licence, provide access to protected downloads, provide support or otherwise provide the requested service.

6. Account Registration and Verification

Tribute Director may require you to create a website account before purchasing, downloading or managing a licence.

We may use your email address to verify or activate your account and to associate purchases and licences with the correct customer.

You are responsible for keeping your account credentials confidential and for notifying us if you believe your account has been accessed without authorisation.

7. Cookies and Website Sessions

Our website may use cookies and similar technologies that are necessary to operate features such as:

  • User login and authentication
  • Session management
  • Shopping cart or checkout functionality
  • Security and fraud prevention
  • Remembering website preferences

Third-party services used during checkout, including Stripe, may also use cookies or similar technologies in accordance with their own privacy policies.

You may configure your browser to restrict or delete cookies. However, blocking cookies that are necessary for authentication, checkout or session management may prevent some parts of the Tribute Director website from working correctly.

8. When We Share Personal Information

We do not sell your personal information.

We may disclose or provide personal information to trusted service providers where reasonably necessary to operate Tribute Director, including:

  • Payment processors, including Stripe
  • Website, server, database and hosting providers
  • Email and transactional communication providers
  • IT, security, backup and technical service providers
  • Professional advisers such as accountants, lawyers or insurers where reasonably necessary

We may also disclose information where:

  • You have authorised us to do so
  • It is necessary for the purpose for which the information was collected or a directly related purpose
  • It is necessary to investigate fraud, abuse, security incidents or unlawful activity
  • We are required or permitted to disclose it by law
  • It is necessary to establish, exercise or defend a legal claim
  • Our business or relevant assets are sold, transferred or reorganised, subject to applicable privacy obligations

9. Overseas Service Providers

Some organisations that provide services to Tribute Director may operate or store information outside New Zealand.

Where personal information is disclosed to an overseas organisation, we will take reasonable steps required by the Privacy Act 2020 to ensure that the information is appropriately protected, or otherwise ensure that the disclosure is permitted under New Zealand privacy law.

The privacy laws applying in another country may differ from those applying in New Zealand.

10. Security

We take reasonable technical and organisational measures to protect personal information against loss, unauthorised access, misuse, alteration and disclosure.

These measures may include, as appropriate:

  • Encrypted HTTPS connections
  • Access controls and authentication
  • Restricted administrative access
  • Server and application security controls
  • Software licence authentication and entitlement checks
  • Security logging and monitoring
  • Use of established third-party payment processors rather than storing full payment card details ourselves

No internet-based service or data storage system can be guaranteed to be completely secure.

11. Privacy Breaches

If we become aware of a privacy breach, we will investigate it and take appropriate steps to contain and manage the breach.

Where a breach is likely to cause serious harm and notification is required under the Privacy Act 2020, we will notify the Office of the Privacy Commissioner and affected individuals as required by law.

12. How Long We Keep Information

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected or as required for legitimate business, legal, accounting, taxation, security, dispute resolution or regulatory purposes.

Different categories of information may be retained for different periods.

For example, deleting or closing a customer account may not require us to immediately delete information relating to completed financial transactions, licence history, audit records, fraud prevention, legal obligations or disputes where continued retention is reasonably necessary or required by law.

When personal information is no longer reasonably required, we will take appropriate steps to delete, anonymise or securely dispose of it.

13. Email Communications

We may send you transactional or service-related communications concerning your account, purchases, licence, subscription, security, software downloads or support requests.

Where we send marketing communications, we will do so in accordance with applicable law. Marketing emails will provide a means to unsubscribe where required.

Unsubscribing from marketing communications does not prevent us from sending communications that are reasonably necessary to administer your account, purchase, licence or subscription.

14. Accessing and Correcting Your Personal Information

You have the right under the New Zealand Privacy Act 2020 to request access to personal information that we hold about you and to request correction of that information.

You may also be able to update some information directly through your Tribute Director customer account.

To request access or correction, contact our Privacy Officer using the details below. We may need to verify your identity before providing or changing personal information.

15. Account Closure and Deletion Requests

You may contact us if you wish to close your Tribute Director account or request deletion of personal information.

We will consider deletion requests in accordance with the Privacy Act 2020 and any other applicable legal or business record-keeping requirements.

Some information may need to be retained after account closure where reasonably necessary for financial records, licence and activation history, security, fraud prevention, dispute resolution or compliance with legal obligations.

Our website may contain links to third-party websites or services.

Those organisations operate independently from Tribute Director and may have their own privacy policies and terms. We are not responsible for the privacy practices of independent third-party websites or services.

The current version will be published on the Tribute Director website and will show the date it was last updated.

Where a change materially affects how we handle personal information, we may provide additional notice where appropriate.
